Accurate representation of both container prices and availability is crucial for building trust, ensuring buyer satisfaction, and upholding the integrity of our marketplace. In principle, the prices listed on the marketplace should be the maximum prices that buyers will pay for the listed containers.
This policy outlines the standards for pricing accuracy, the prohibition of bait and switch tactics, the consequences of misrepresentation, best practices for sellers to ensure compliance, and the advantages of maintaining accurate listings.
Policy on Bait and Switch & Misrepresentation of Prices
Definitions
- Misrepresentation of Prices: Providing inaccurate or misleading pricing information in listings, either unintentionally due to lack of updates or negligence, or intentionally to deceive buyers.
- Deceptive Negotiation Tactics (Bait and Switch): A deliberate practice where a seller advertises containers at a low price to attract buyers but then increases the price, limits the availability, or alters terms during negotiations. This includes tactics such as promising better or faster service, better prices elsewhere, or other incentives to lure buyers away from the original offer.
Accepted Listing Types and Pricing Policies
To prevent misrepresentation and promote transparency and clarity of prices on the Container xChange platform, the following listing types are available for sellers:

Negotiable Price Listings
- Description: Listed prices under this category are negotiable. Negotiable here means prices may be reduced, e.g., if a larger volume is bought or the seller offers a lower price to win the business. Prices must not be increased within 24 hours after a negotiation has been started because this would equate to a misrepresentation of prices in the first place. Container prices are volatile, so it is acceptable to increase the prices after 24 hours if the buyer has not accepted your offer yet.
- Seller Responsibility: While prices are negotiable, sellers must ensure that any price changes during negotiations are communicated transparently and are justifiable based on market conditions or container specifications (e.g., higher prices for specific container colors are sometimes normal but must be communicated in the listing's comment section).

Non-Negotiable Price Listings
- Description: Prices are non-negotiable and set at a specific amount.
- Seller Responsibility: Use this listing type when you do not intend to lower the price under any circumstances.
- Best Practices: Accurately reflect the current market value and ensure the price is competitive yet fair. To maintain up-to-date prices, sellers should update the prices daily or as soon as they change to avoid misrepresentation of prices.

Instant Sales Offer (ISO)

Description: Buyers can purchase containers with a single click at a fixed, non-negotiable price without requiring seller confirmation, guaranteeing the availability of the container.

Seller Responsibility: Prices and other listing details must be accurate and reflect the true value and description of the containers.

Consequences for Inaccuracy:
- Cancellation Fee: Sellers will incur a $100 USD cancellation fee per container if the listing is found to be outdated or inaccurate.
- Listing Removal: Misrepresented Instant Sales Offers will be removed from the platform.

- Daily Updates: Ensure all Instant Sales Offers are updated daily to reflect current availability and pricing.
- Extra Attention on Availability: If you are selling the same container on other channels outside Container xChange, make sure that if it's sold elsewhere, you immediately take down the listing on xChange to avoid having an outdated listing.
Consequences of Misrepresentation of Prices or Bait and Switch
To uphold marketplace integrity, xChange enforces the following measures for violations of this policy:

Listing Removal
- Immediate Action: Listings identified or reported as misleading will be taken down by our team, requiring sellers to correct them and relist accurately.

Negative Impact on Listing Accuracy Score
- Monitoring: Decline reasons related to pricing discrepancies (e.g., "Wrong price advertised") are tracked.
- Accuracy Score: A high number of negative decline reasons provided by buyers will lower the seller’s Listing Accuracy Score.

Financial Consequences
- Cancellation Fees: In cases of misrepresentation of prices, the seller will be penalized with a cancellation fee of $100 per unit.
- No Refund of Subscription Fees: In case of suspension or ban, there will be no refund of subscription fees.

Account Restrictions
- Deactivation of Listing: If a misrepresentation of prices is reported or identified by xChange, the listing will be deactivated, resulting in less visibility for the seller's offers.
- Temporary Suspension: Repeated violations may lead to a temporary suspension of the seller’s account for seven days or more in severe cases as a final warning.
- Permanent Ban: Continued non-compliance after a temporary suspension may result in a permanent ban from the platform.
Handling Specific Cases

- Definition: Occurs when sellers fail to fulfill their obligation to always keep their listings up-to-date with accurate pricing information, leading to discrepancies between the listed maximum price and the higher price communicated during negotiations.

- Ranking Down: Listings with outdated or inaccurate prices will negatively impact the seller’s Listing Accuracy Score, resulting in lower search rankings and fewer business opportunities.
- Listing Removal: Consistent inaccurate listings will be removed from the platform by xChange, requiring sellers to rectify them and relist accurately.

Deceptive Negotiation Tactics (Bait and Switch)
- Definition: Involves intentionally advertising low prices in the listing to attract buyers and then increasing the price or altering terms during negotiations. This also includes tactics like promising better or faster service, better prices elsewhere, or other incentives to divert buyers from the original offer.

Consequences:
- Immediate Listing Removal: Any listing found using deceptive tactics will be immediately removed from the platform.
- Account-Level Repercussions: Sellers engaging in deceptive tactics will face stricter penalties, including official warnings, followed by temporary suspension or even a permanent ban, to preserve marketplace integrity.
Best Practices for Sellers
To prevent misrepresentation and maintain high listing accuracy, sellers must fulfill their obligation by adhering to the following best practices:

Daily Listing Updates/Updates immediately after any listing element changes
- Regular Maintenance: Update your container listings at least once daily to reflect current availability and pricing accurately.
- Prompt Adjustments: Immediately remove or adjust listings for containers that have been sold out and are no longer available. Keeping listings online after turning down an approaching buyer stating that units are unavailable is considered a breach of our rules.
